ԱԺ-ն ընդունեց ապօրինի ծագում ունեցող գույքի բռնագանձման մասին օրենքը

Խորհրդարանը 99 կողմ, 1 դեմ և 15 ձեռնպահ ձայներով երկրորդ ընթերցմամբ և ամբողջությամբ ընդունեց «Ապօրինի ծագում ունեցող գույքի բռնագանձման մասին» օրենքի նախագիծը՝ կից օրենսդրական փաթեթով:

Նշենք, որ ըստ օրենքի՝ ապօրինի ծագում ունեցող գույքը ենթակա է բռնագանձման, եթե ներկայացված ապացույցների գնահատմամբ դատարանը հանգում է հետևության, որ այդպիսի գույքի շուկայական արժեքը հայցի ներկայացման պահին գերազանցում է հիսուն միլիոն ՀՀ դրամը: Նախագծի համաձայն՝ գույքի արժեքի շեմը 50 մլն դրամ է:

Ուսումնասիրության ենթակա են 1991 թվականի սեպտեմբերի 21-ից հետո ձեռք բերված գույքերը: Հիմնականում քննության է ենթարկվելու վերջին տասը տարում ձեռք բերված գույքերի օրինականությունը:
