Խորհրդակցական սենյակից վերադառնալով՝ դատավորը միջնորդությունը մերժեց: Հաջորդ դատական նիստը նշանակվեց նոյեմբերի 12-ին:

Ռոբերտ Քոչարյանն ավելի վաղ հայտարարել էր, որ ամենքից շատ է շահագրգռված արդար դատով եւ նշել էր պոտենցիալ ազդեցության օբյեկտի բացակայությունը: «10 տարի անց ես չեմ կարող փոխել ԱԴ հայտարարելու մասին իմ հրամանը: Սա փաստ է, որից ես չեմ հրաժարվում: Հանդիպման փաստը նույնպես փաստ է: Չկա դրդապատճառ, չկա ներգործության սուբյեկտ: Այստեղ նստած մարդիկ իրենց թույլ չեն տա խնդրանքով դիմել որեւէ մեկին, որը կվիրավորի նրանց արժանապատվությունը: Ես ամոթից կմեռնեի, եթե ստիպված լինեի որեւէ մեկին խնդրել ռետուշավորել իր ցուցմունքները: Ֆեմիդայի կշեռքը ձեր ձեռքին է»,- հայտարարել էր Քոչարյանը:
