Մարդու իրավունքների եվրոպական դատարանը ստացել է Երևան քաղաքի Առաջին ատյանի ընդհանուր իրավասության դատարանի և Ռոբերտ Քոչարյանի դիմումների հիման վրա Սահմանադրական դատարանի կողմից քննության ընդունված գործերով խորհրդատվական կարծիք ստանալու համար Սահմանադրական դատարանի կողմից Մարդու իրավունքների եվրոպական դատարան ներկայացված դիմումը։ Այս մասին հայտնեցին Սահմանադրական դատարանի աշխատակազմից։

Մարդու իրավունքների եվրոպական դատարանի կողմից հաստատվել է դիմումը ստանալու հանգամանքը, ինչպես նաև տեղեկացվել է դիմումի՝ առաջնահերթության կարգով քննարկման ենթակա լինելու մասին։

Հիշեցնենք՝ Սահմանադրական դատարանը որոշել էր դիմել Մարդու իրավունքների եվրոպական դատարան և Վենետիկի հանձնաժողով՝ Երևանի ընդհանուր իրավասության դատարանի և Ռոբերտ Քոչարյանի դիմումների հիման վրա Քրեական օրենսգրքի 300.1-րդ հոդվածի (Սահմանադրական կարգը տապալելը)՝ Սահմանադրականության հարցը որոշելու վերաբերյալ խորհրդատվական կարծիք ստանալու համար։
