Թերլիցքավորման համար «ՍՏԱՐՏ ՕԻԼ»-ը կվճարի 1 մլն դրամից ավելի տուգանք

ՀՀ շուկայի վերահսկողության տեսչական մարմնի կողմից իրականացված վերահսկողական միջոցառման արդյունքում «ՍՏԱՐՏ ՕԻԼ» ՍՊԸ-ին պատկանող՝ Երևան քաղաքի Դավիթ Բեկի 83/9 հասցեում գործող լցակայանում արձանագրված թերլիցքավորման դեպքի առնչությամբ ընդունված 2024 թվականի ապրիլի 10-ին ընդունված թիվ 119 որոշման (այսուհետև՝ Որոշում) իրավաչափությունը Ընկերության կողմից վիճարկվել էր դատական կարգով։

Որոշմամբ նախատեսված էր նշված լցակայանում մեկ ամիս ժամկետով փակցնել «ՄԵՆՔ ՏՈՒԳԱՆՎԵԼ ԵՆՔ ԹԵՐԼԻՑՔԱՎՈՐՄԱՆ ՀԱՄԱՐ» պաստառ։

«ՍՏԱՐՏ ՕԻԼ» ՍՊԸ-ն Որոշումն անվավեր ճանաչելու պահանջով հայց է ներկայացրել ՀՀ վարչական դատարան, որը մերժել է ներկայացված հայցը։

Դատարանի վճռի դեմ Ընկերության կողմից ներկայացված վերաքննիչ բողոքը ՀՀ վերաքննիչ վարչական դատարանի՝ 2026 թվականի օգոստոսի 19-ի որոշմամբ մերժվել է, իսկ ՀՀ վարչական դատարանի վճիռը՝ թողնվել անփոփոխ։

Ստուգման արդյունքում արձանագրված թերլիցքավորման համար տնտեսվարողը ՀՀ պետական բյուջե կվճարի 1 084 992 (Մեկ միլիոն ութսունչորս հազար ինը հարյուր իննսուներկու) ՀՀ դրամ։

Արձանագրված իրավախախտման հիմքով Շուկայի վերահսկողության տեսչական մարմնի ղեկավար Արմեն Կոտոլյանի հրամանով լցակայանում 1 ամիս ժամկետով փակցվել է «Մենք տուգանվել ենք թերլիցքավորման համար» պաստառ։
