ՀՀ գլխավոր շտաբի պետ Արտակ Դավթյանին մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 375-րդ հոդվածի 3-րդ մասով` պետի (հրամանատարի) կամ պաշտոնատար անձի կողմից իշխանությունը կամ պաշտոնեական դիրքը չարաշահելը, իշխանազանցությունը կամ պաշտոնեական լիազորությունների սահմանն անցնելը, ինչպես նաև իշխանության անգործությունը, եթե այդ արարքները կատարվել են շահադիտական, անձնական այլ շահագրգռվածությունից կամ խմբային շահերից ելնելով, և եթե դրանք նյութական ծանր հետևանքներ են առաջացրել: Այս մասին հայտնում է ՀՀ գլխավոր դատախազությունը:
 
Հոդվածի այս կետով 4-8 տարվա ազատազրկում է նախատեսվում` գույքի բռնագրավումով կամ առանց դրա:
